Captain's Mate Posts: 721 01/11/12 01:45 PM	Tags : None I was looking at the state regs and was wondering where we fall in the "Regions" of Florida? It states that you can possess 2 Red Drum (in slot) in the NE and NW regions but only 1 in the South Region. Couldn't find a map for the divisions. Can someone post one? Also, it says for Red Snapper that 20" Atlantic; 16" Gulf and..... (Closed season) July 16 - May31 Gulf. Does that mean that within 3 miles on the Atlantic side you can keep Red Snapper year round if within slot? Capt's Pet Posts: 235 01/11/12 08:26 PM - 10 Limits 2011	My understanding is that you may keep 2 red snapper 20" or bigger if you catch them less than 3 miles offshore. I know several people who have seen them come into port canaveral in a fish box. When questioned by my friends the answer was we caught them inside 3 miles. I would call the fwc to verify but there regs do show you can keep 2.

We 'fisher-people' who fish often, live here and want to do what is right, have problems interpreting those ever changing regulations. It's almost like our very own government is trying to trip us up just to catch us and fine us. For instance, when I'm driving down I-95 and I see a speed sign that says, Speed Limit 70 MPH, I get it... If I go 85... it's plainly my fault. But if the State/Gov't were to put the signs back in the woods in the brush where it is hard to see and easy to miss and changes often, and I'm going 75 MPH in a 60 MPH zone, even if you say "it was 70 MPH here last week, when did they change it?" you get a ticket. There must be a simpler, cleaner and more honest way for citizens to stay within the lines. Besides, we CITIZENS should make the decisions and not the politicians. Phew, glad I got that off my chest. Think I'll go fishing... << There Is a Reason >>

Of the 4 PDF's, choose either printer friendly regs booklet ( page 4 ) or PDF saltwater regs booklet ( page 6 ).

Capt's Pet Posts: 235 01/13/12 08:57 AM - 10 Limits 2011	It is really difficult to understand what you can keep. It would be nice if the feds just got out of the way and let the fwc create the rules. Cobia is another example. Federal 2 per person state 1 per person. How do they know how far out the fish was caught.The Feds really fooled us when they first started talking about snapper restrictions. I thought just american red snapper. Now all you you can keep offshore this time of year is king, cobia,trigger, lane, mangrove.( I think) I had a hard enough time justifying to the wife spending ave $300 to $400 ( my boat is to small to add more people to lessen the expenses) in gas to bring home some grouper and snapper. I will fish fewer days and put another dent into the economy.

I'm not condoning it and I'm not saying I really want to find out IF and how they can prove it but wouldn't they have to have some proof other than a fish to charge you? They gonna take my gps and look at my tracks? They gonna go check every spot to see if snapper live there? Innocent until proven guilty right? Besides FWC is gonna check your catch right, not the feds? I wonder what they would say if you showed them a couple legal snapper you claimed to have caught inside 3 miles? They are gonna say "bull sh**"... well prove it! I've never seen a federal officer at the boat ramp, on the water, or EVER that I can remember. It should all be state regulated, if FWC is gonna be the one at the dock checking my fish box, FWC should make the rules. I really think that if eventually something doesn't change regulation wise people will start to disregard the federal regs. It may even turn into something like California and the loosey goosey marijuana laws. Federal law prohibits the sale/use but under CA regulations its pretty much ignored. Any day the feds can crack down on that entire industry (and it is a HUGE industry in CA). Sorry for the odd comparison, might not make any sense, but if the federal and state regs don't jive eventually people will discover a loop hole and exploit it. Some FWC officers are federally Deputized, and thus can enforce federal Rules, even patrolling Federal waters, either on a stste boat, or with orher marine OLE agencies. I've only seen a state officer out Once in Federal waters, doing random checks, along with local OLE. The law allows a wide lattitude of search and even seizure of fishing boats, and probable cause is simply seeing a fishing rod on your boat to search for fishing violations. If GPS is on the boat, they can look at your data to see where you have been for the day. They still have to prove you caught Red Snapper in federal waters. Red Drum are not allowed in possesion in Federal waters, even if caught in state waters, on your way out! Same for Red Snapper, should you catch a keepable one inside 3 miles, you cannot travel with it outside the 3 mile limit. Many other fish have variations between state and Federal waters, like Cobia, which allows 2 pp in Federal waters, but only 1 pp in state. In that case, if you catch 2 in Federal waters pp, you can return to state waters, even though technically over posession limits, as long as fishing gear is stowed upon return to state waters. In that case you could be required to prove they were caught in federal waters, by providing GPS record showing no stops were made on the return trip to the docks. Its a big mess, but despite the stste's shortcommings, NOAA's has made a much bigger mess of things than the state. The Feds have tasked the Coast Guard to enforce Federal regulations and they have done boarding this past year off both Ponce Inlet and the Port. As well, local Sherriff's office can write a citation for a Federal violation if they wish. In 2010, after Snapper regs went into effect- we were searched by Volusia County SO on 8 consecutive trips at Ponce starting in early Jan 2010 looking specifically for Red Snapper, In 2011 I had no encounters with Volusia SO- but was checked by FWC on 3 occasions, we were not carrying any contraband fish per Fed regs. so no action taken. I have heard that the FWC is not taking action on ARS and Black Sea Bass if they are legal size and numbers per State Guidelines if you say "they were caught in State Waters" but I have yet to be able to actually confirm this. I beleive it is going to be a case of how the individual officer wants to handle the situation and what his personal opinion of the BS Federal regulations are and wheteher he is having a bad day or not or you piss them off..
